It is exactly what I want, but....

...it has 240k miles!!!!!!

Is it worth it for a 40 mile commute each day? Would it just be awful?

Nope. Not worth it. Unless there is maintenance records for all 240,000 miles I wouldn't risk the $3k on it. I was grappling with your same dilemma of realizing BMW's are actually attainable on the used market, I was mainly looking at the e39's and there were a few nice ones with around 150,000 on them but I still thought that to be too big of a gamble if things went wrong. If you up your budget a bit you might be able to find a decent bimmer. Another car you could try to look into would be an '03+ Lincoln LS V8. Decent examples with right around 100,000 miles can be had for about $5k. Just be aware that the ignition coils go bad so if you feel a misfire you got to replace all 8 coils, its just a known issue with the damn design ford and jag used on those cars. The window regulators break and its a relatively easy job to do you need a rivet gun, two of the suction cups on a string delio-bobs and about 30 minutes to get it done.
